Energy Raven (“Energy Raven,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy (“Policy”) explains what Personal Information we collect and how we use, share, and protect that Personal Information when you use our website, www.energyraven.com, (“Website”), or products and services (“Services”). We refer to our Website, App, and Services as our (“Platform”).

This policy DOES NOT apply to information that:

  • We collect offline or on any other our apps or websites, including websites you may access through this Platform.
  • You provide to or is collected by any third party (see Third-Party Information Collection).

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use this Platform. By downloading, registering with, or using this Platform, you agree to this privacy policy. This policy may change from time to time. Your continued use of this Platform after we revise this policy means you accept those changes, so please check the policy periodically for updates.

We may modify this Policy at any time. Material changes will be conspicuously posted on the Platform or otherwise communicated to you and will be effective immediately.

Personal Information

“Personal Information” is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household. Personal Information does not include publicly available information or aggregated information that does not include personal identifiers.

Categories of Personal Information We Collect

Depending on how you use our Platform, we may collect the following categories of Personal Information:

  • Identifiers: Information such as your real name, email address, telephone number, online identifier, IP address and other similar information.
  • Commercial Information: Services you have purchased, obtained, or considered and the content of your related communications with us.
  • Payment Information: If you are a home inspector, we may collect certain information from you when you pay for our Services. However, we use a third party payment provider to process payments and therefore will not directly collect or store your full payment card information.
  • Internet Activity: Internet or other electronic network activity information, including, but not limited to, the pages of our Platform that you visit and the amount of time you spend on those pages, the time and date of your visit, browsing history, search history, and information regarding your interaction with our Platform. We may also collect information that your browser sends whenever you visit our Platform or when you access the Platform by or through a mobile device.
  • Device information: Information such as the IP address, general geographic location, operating system, browser type, browser version, language preferences, mobile phone number, device identifier and other similar information associated with a device used to access, use, or interact with the Services.
  • Geolocation Data: Location information, such as the city, state and ZIP code associated with your IP address.
  • Employment-Related Information: Your current employer, if you are a home inspector.
  • Other information you provide to us.

How we Collect Personal Information

Most of the Personal Information we collect is collected directly from you. In some cases, we may collect Personal Information from third parties in the ways described in this Policy.

Directly From You

When you access, use or otherwise interact with our Website and Web portal, or otherwise engage with us in connection with our Services, such as when you create an account with us or request additional information, we may ask you to provide certain Personal Information.

Automatic Data Collection

We may collect certain information automatically through our Platform, such as your IP address, mobile carrier, and other device identifiers that are automatically assigned to your computer or device when you access the Internet. Information from Third Parties

We, or third parties acting on our behalf, may collect Personal Information about you from third parties, including, without limitation, online and offline sources, entities affiliated with us, our parent companies, our service providers, third party services, social media platforms, advertising networks and other public or commercial sources (collectively, “Third Party Sources”). The collection of Personal Information from these Third Party Sources can occur in a variety of ways, including, without limitation:

  • We, or third parties acting on our behalf, may receive Personal Information about you from third parties that provide services to us through or in connection with the performance of our Services or the operation of our Platform (“Service Providers”). Service Providers may include, without limitation, hosting providers and payment providers. For example, we currently use Stripe as our payment processor.   • We may receive information from third parties whose content is linked to on our Platform. Any links to other websites, applications or other third party content on our Platform, are not an endorsement, authorization, or representation of our affiliation with that third party and we are not responsible for the content, privacy and security policies and practices of any third party. We encourage you to read the privacy policies or statements applicable to any third party websites, applications, or content you access.
  • We, or third parties acting on our behalf, may also receive Personal Information about you from other third parties, such as other users of our Platform.

Please note, we may combine the Personal Information and other content and information we receive about you from multiple sources, including, without limitation, Personal Information we collect directly from you and one or more Third Party Sources.

How we Use Personal Information

The primary purposes for which we use Personal Information are:

Customer Service and Customer Communications. We may use Personal Information to (1) provide customer service and support, (2) respond to your requests for information about our Services, and (3) send you emails, calls, and text messages to provide you with alerts and updates about your engagement with the Platform.

Provide and Maintain our Services. We may use Personal Information to provide and maintain our Services.

Business Purposes. We may use Personal Information for business purposes including but not limited to:

  • Creating your home’s profile on the Platform,
  • Providing information about our products and Services,
  • Responding to requests you send to us and to third parties,
  • Sending you push notifications with your consent,
  • Carrying out our obligations and enforcing our rights arising from any contracts we have entered into, including, without limitation, any contracts between you and us;
  • Operating and improving our products and Platform;

  • Customizing your experience with our Platform;
  • Preventing fraud; assessing the success of our marketing and advertising campaigns; and
  • Other business purposes permitted under applicable law.

Marketing Purposes. We may use your Personal Information to advertise and market to you including notifying you of special promotions, sweepstakes and contests, opportunities, offers and events through e-mails, and other means. We also use Personal Information to serve you targeted ads that are tailored to your interests and/or location and to measure their effectiveness (and work with third-party vendors who do so).

Law Enforcement/Legal Purposes. We may use Personal Information to cooperate with law enforcement or for other legal purposes including: (1) complying with legal and regulatory requirements; (2) cooperating with law enforcement or other governmental agencies for purposes of investigations, public safety or matters of public importance when we are legally required to do so or believe that disclosure of Personal Information is necessary or appropriate to protect the public interest; and (3) protecting and defending against legal actions or claims.

Please note, we may use and disclose aggregated, anonymized, or de-identified information collected in connection with our Platform and other information that does not identify any individual (“Anonymized Data”) for any lawful purposes, which may include, without limitation, purposes not described in this Policy. Except as otherwise required under applicable laws, our use and disclosure of such Anonymized Data is not subject to this Policy.

Disclosing Information to Third Parties

We may share your Personal Information with certain third parties including:

  • Service Providers. We may share Personal Information with service providers. For example, we may share Personal Information with vendors to help us host and manage our Platform.
  • Business Partners and Affiliates. We may share Personal Information with our business partners and affiliates for our business purposes or to provide you with a product or service that you have requested. We may also provide Personal Information to our Affiliates, including without limitation, American Family Insurance, for their business purposes.
  • Marketing Partners. We may share Personal Information to facilitate the delivery of targeted ads, promotions and offers to you, on and off the Platform.
  • Parties to Business Transactions. In the event of an anticipated or actual merger or acquisition, bankruptcy or other sale of all or a portion of our assets, we may transfer or allow third parties to use information owned or controlled by us, including Personal Information. We reserve the right, in connection with these types of transactions, to transfer, share, assign, or sell your Personal Information and other information we have collected to third parties or to authorize such third parties to use any such information including for due diligence as part of any of the transactions described in this paragraph. Any Personal Information you submit or that is collected after this type of transfer may be subject to a new privacy policy adopted by the successor entity.
  • Government and Law Enforcement. We may share your Personal Information with individuals or private parties where necessary to enforce and comply with the law, to protect our property or legal rights, for the safety of the public or any person, to prevent harm, and to protect the security and integrity of the Platform.
  • Professional Advisors. We may share Personal Information with our professional advisors, such as our attorneys, accountants, financial advisors, and business advisors, in their capacity as advisors to us.
  • Other users: Depending on how you use the Platform, we may share your Personal Information with other users such as property managers and home inspectors.

Other. We may share Personal Information with third parties at your request or with your explicit consent.

Tools We Use and Your Choices

Marketing Communications; Opt-Out

We may use your Personal Information to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt-out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send or by contacting us happytohelp@energyraven.com To opt-out of text messages, reply “STOP.” To opt-out of other communications (e.g., postal marketing and telemarketing), please adjust your contact preferences in your online account, contact us by phone, e-mail or mail using the contact information below. Opting out of marketing communications does not opt you out of communications about your account or transactions.

Cookies and other Tracking Technologies

We use cookies and other tracking technologies including pixel tags and web beacons to gather more information about how our Platform is used.

A “cookie” is a small text file that our Website and App save onto your computer or device when you use the Platform that allows the Website or App to remember your actions and preferences and recognize you or your browser. Web beacons / pixel tags are small graphics on a webpage that monitor your activity when viewing a webpage.

What is Collected and Why? We use cookies and other tracking technologies to learn whether the Platform is operating optimally, to learn whether you are a repeat visitor to our Platform, for personalized advertising, to provide us with valuable data and statistics about the usage and effectiveness of our Website and App, and to enable us to provide an enjoyable, personalized and innovative online experience for you. We may combine information gathered from cookies with other Personal Information.

Generally, the type of information we collect through cookies is specific to your computer or other device and includes the IP address, date and time the device accessed our Platform, your internet services provider, the device ID number, approximate geographic location, browser type, the websites you visit before and after coming to our Website, and whether the web pages requested were delivered successfully.

Disabling Cookies. Most browsers automatically accept cookies. You can disable this function, but disabling cookies may impact your use and enjoyment of the Platform. Pixel Tags. Certain pages on our Website and App may contain “pixel tags” also known as internet tags, web beacons and clear GIFs. A pixel tag is a small graphic image placed on the web page designed to allow us to monitor and obtain information about our Website traffic, such as the IP address of the computer that downloaded the page on which the tag appears, the URL of the page, the time the page was viewed, the type of browser used to view the page, and the information in cookies set by vendors we use to assist us with advertising to you. We also use pixel tags to recognize a unique cookie on your web browser, which enables us to learn which advertisements brought you to our Platform.

Analytics.

Our Platform uses third-party analytics tools, including those listed below.

  • Google Analytics. Google Analytics is a web analytics tool that assists us in understanding how our Platform is used. Google Analytics will place cookies on your device that will generate information we select about your use of the Website and App, including your device’s IP address. That information will be transmitted directly to and stored by Google. The information will be used for the purposes of evaluating use of the Platform, compiling reports on activity on the Website and App for our use and providing other services relating to activity on, and usage of, the Platform. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf.   • Firebase. Firebase is an analytics service provided by Google Inc.   • HubSpot Analytics. We may use HubSpot Analytics, a web analytics service provided by HubSpot, Inc. that uses cookies and beacons to track how long users are on our Platform, what marketing pages they visit, what marketing offers they respond to, the user’s identity, to improve our customer education material, and to set up accounts and operate our Platform. Social Media

We are active on social media, including Facebook, Instagram, LinkedIn, TikTok, Twitter, and YouTube (“Social Media”). Anything you post on Social Media is public information and will not be treated confidentially. We may post (or re-post) on the Platform and our Social Media pages any comments or content that you post on our Social Media pages. Your use of Social Media is governed by the privacy policies and terms of the third parties that own and operate those websites and not by this Policy. We encourage you to review those policies and terms before using any Social Media features provided through our Site or third-party websites. We also use advertising networks and services offered by Social Media companies for marketing and advertising purposes. As a result, the applicable Social Media company may drop cookies or pixel tags on your device when you use the Platform as described in the “Tools we use and your Choices” section above.

Children

Our Platform is not directed to children under the age of 16, and we do not knowingly collect Personal Information from children under the age of 16. If you learn that your child has provided us with Personal Information without your consent, please alert us and we will take steps to delete such information as soon as possible.

Third-Party Websites

The Platform may link to, or be linked to, websites not owned or controlled by Energy Raven. Energy Raven is not responsible for the privacy policies or practices of any third parties or any third-party websites. This Policy does not apply to any third-party websites or to any Personal Information that you may provide to third parties. You should read the privacy policy for each website that you visit.

California Privacy Rights

If you are a California resident, under California’s Shine the Light Law (California Civil Code Section 1798.83) you have the right to request the following information regarding our disclosure of your Personal Information to third parties for direct marketing purposes: (1) the categories of Personal Information we disclosed to third parties for their direct marketing purposes during the preceding calendar year; (2) the names and addresses of the third parties that received the information; and (3) if the nature of the third party’s business cannot be determined from their name, examples of the products or services they marketed. This information may be provided in a standardized form that is not specific to you.
